1. Acceptance of Terms

By installing, accessing, or using X Media Downloader (the "Extension"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Extension.

We reserve the right to modify these Terms at any time. Your continued use of the Extension after any changes constitutes acceptance of the new Terms.

2. Description of Service

X Media Downloader is a browser extension that allows users to download images, videos, and GIFs from X/Twitter. The Extension offers both free and paid (Pro) subscription tiers with different feature sets.

Free Version

• Download first 10 media files from user profiles
• Download images from individual tweets

Pro Version

• Unlimited media downloads from profiles
• Video download capability
• Priority customer support
• Advanced organization features

3. User Accounts and Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Extension.

4. Subscription and Payment

Pro Subscription

The Pro subscription is billed on a recurring basis (monthly, quarterly, or annually) through our payment processors (Paddle or PayPal). By subscribing, you agree to:

• Pay all fees associated with your subscription
• Automatic renewal unless cancelled before the renewal date
• Price changes with 30 days' notice

Cancellation and Refunds

• You may cancel your subscription at any time from the Extension settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial subscription periods
• Refunds may be provided at our sole discretion for technical issues

Free Trial

If we offer a free trial, you will not be charged until the trial period ends. You may cancel before the trial ends to avoid charges.

5. Acceptable Use

You agree NOT to:

• Use the Extension for any illegal purpose
• Download content that infringes on intellectual property rights
• Violate X/Twitter's Terms of Service
• Attempt to reverse engineer, decompile, or disassemble the Extension
• Use the Extension to harass, abuse, or harm others
• Distribute malware or engage in any malicious activity
• Attempt to circumvent any limitations or restrictions
• Use automated systems to access the Extension beyond normal usage
• Resell or redistribute the Extension or its features

6. Intellectual Property Rights

Our Rights

The Extension, including its code, design, features, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Extension for personal use.

Your Responsibilities

You are solely responsible for ensuring you have the right to download and use any content obtained through the Extension. We do not claim ownership of any content you download.

You acknowledge that downloading copyrighted content without permission may violate copyright laws. We encourage you to respect intellectual property rights and only download content you have permission to use.

7. Disclaimer of Warranties

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Extension will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any content

We do not guarantee that the Extension will always be compatible with X/Twitter or that it will continue to function if X/Twitter changes its platform.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Unauthorized access to your data
• Third-party conduct or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you have not made any payments.

9. Indemnification

You agree to indemnify, defend, and hold harmless X Media Downloader, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Extension
• Your violation of these Terms
• Your violation of any third-party rights
• Your downloaded content or its use

10. Third-Party Services

The Extension interacts with X/Twitter and uses third-party payment processors. We are not responsible for:

• X/Twitter's terms, policies, or changes to their platform
• Third-party payment processor terms and policies
• Any issues arising from third-party services

Your use of third-party services is subject to their respective terms and policies.

11. Termination

We reserve the right to suspend or terminate your access to the Extension at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the service
• Non-payment of fees

Upon termination, your right to use the Extension will immediately cease. Sections that by their nature should survive termination will remain in effect.

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Extension (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Extension shall be resolved through binding arbitration, except where prohibited by law. You agree to waive your right to a jury trial or to participate in a class action.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Extension and supersede all prior agreements and understandings.
